Terms of Service
Momentum Health Technologies LLC · Effective October 7, 2026
1. Acceptance and scope
These Terms of Service govern your use of the Momentum app, momentumhealthtechnologies.com, and related services provided by Momentum Health Technologies LLC (“Momentum,” “we,” “us”). By using the service, you agree to these Terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle personal information.
2. Eligibility
You must be legally able to enter into these Terms and meet the age and consent requirements applicable where you live. Momentum is not for children under 13 or below a higher applicable minimum age for independent consent. If you are a minor, you may use the service only with any legally required permission and supervision of a parent or guardian, who must review these Terms with you. Do not use the service where doing so would be unlawful.
3. Accounts and security
Use accurate account information and a sign-in account you are authorized to use. Launch authentication supports Sign in with Apple and Google Sign-In; production email/password sign-in is disabled. Keep your device and sign-in provider account secure. Do not share access, impersonate another person, or create accounts to evade a restriction or manipulate results. Tell us promptly if you suspect unauthorized use. You are responsible for your use of the service, subject to applicable law.
4. Health and activity data
You choose whether to connect Apple Health/HealthKit or Android Health Connect and which permissions to grant. You authorize the processing needed to provide the activity features you choose, subject to the Privacy Policy and applicable consent requirements. Revoking permissions may limit features or prevent activity from qualifying.
Health platforms, devices, and source apps can produce incomplete, delayed, or inaccurate records. Momentum validates supported activity and may reject duplicate, manually entered, untrusted, or implausible evidence. Your device’s total may differ from a verified challenge total. Do not falsify records or submit another person’s activity.
5. Challenges and measurable rules
Launch competitive metrics are steps and distance. Challenges are voluntary. Before joining, review the displayed metric and units, goal, start/end dates, applicable time zone and daily cutoff, qualifying-activity requirements, scoring method, and any tie or completion rules. Those disclosed rules govern that challenge alongside these Terms. If a rule is unclear, contact support before relying on an expected result.
Only activity accepted under the challenge’s rules counts. Keep relevant permissions enabled and sync activity as required by the challenge. Goals, daily qualification, standings, and final results depend on validated evidence. We may review disputed evidence and correct calculation errors or results affected by cheating. Contact support with the challenge identifier and affected dates to request review.
Currently available challenges are free and do not involve live-money entry fees, cash prizes, or payouts. Paid-entry availability is disabled. Points, streaks, badges, rankings, and challenge achievements are progress indicators and have no cash value or redemption right. These Terms do not create a right to payment or authorize paid contests.
Any paid or prize-based challenges, if offered in the future, will be subject to separate eligibility requirements, geographic restrictions, official rules, and applicable law. No U.S. state or other jurisdiction is designated as approved for paid entry by these Terms. Florida governing law and the venue provisions below do not establish paid-challenge eligibility. Paid entry will remain unavailable until the required legal reviews and written payment-processor approval for the specific model are completed.
6. Fair play and prohibited conduct
You must not manipulate sensors or activity evidence; spoof devices, identities, or location-related evidence; bypass integrity checks; exploit bugs to affect standings; coordinate fraudulent results; misuse invitations; harass or threaten others; post unlawful, infringing, or abusive material; collect others’ personal information without authority; distribute malware; disrupt the service; or attempt unauthorized access. Reverse engineering and similar restrictions apply only to the extent permitted by law and do not limit rights that cannot lawfully be restricted.
7. Community content
Where messaging or community features are available, you remain responsible for your posts and must have the rights needed to share them. You retain ownership of your content and grant Momentum a nonexclusive license to host, store, reproduce, and display it as needed to operate those features and enforce these Terms. This license does not grant unrelated rights to use your private health data.
Other users with access to a challenge or community may see content and participation information you share there. Avoid posting sensitive information. We may remove content or restrict access for violations, safety, or legal reasons. Use available reporting/blocking tools or contact support to report abuse.
8. Suspension, termination, and deletion
You may stop using Momentum and request account or data deletion through Support. We may restrict, suspend, or terminate access when reasonably necessary to address violations, cheating, security risks, unlawful conduct, or a legal requirement. Where appropriate and lawful, we will provide notice and an opportunity to contact support about a decision.
Account suspension and permanent data erasure are different processes. The initial in-app deletion request suspends access and revokes sessions and push tokens; data erasure and any retention exceptions are addressed in our Privacy Policy. Provisions that by their nature should survive termination, including ownership, lawful liability limits, and dispute provisions, continue to apply.
9. Intellectual property
Momentum and its licensors own the service’s software, branding, design, and content other than user-owned content. Subject to these Terms, you may use the service for personal, lawful purposes. No ownership rights are transferred. Do not reproduce or commercially exploit our protected materials without authorization, except as applicable law permits.
10. Third-party services
Apple, Google, health platforms, device manufacturers, authentication providers, and notification or infrastructure providers offer services Momentum may depend on. Their own terms and privacy policies may apply. We do not control their availability, data accuracy, or account decisions. A reference to a third-party service does not mean that provider sponsors or administers a Momentum challenge.
11. No medical advice
Momentum provides general fitness, activity, and motivation features. It is not a medical device, diagnosis, treatment, or substitute for professional medical advice. Goals and activity estimates are not a statement that an activity is safe for you. Consider your own condition, seek appropriate professional advice, and stop activity if you feel unwell. Do not use Momentum for emergencies.
12. Availability and disclaimers
Features can vary by platform, version, permissions, and region. We may maintain, update, change, or discontinue features, subject to applicable law and any notice obligations. We do not guarantee uninterrupted access, error-free syncing, compatibility with every device, any particular challenge outcome, or a health or fitness result.
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Statutory warranties and other rights that cannot be excluded remain in effect.
13. Limitation of liability
To the extent permitted by applicable law, Momentum is not liable for indirect, incidental, consequential, or special losses arising from use of the service, including lost profits or loss of data. This exclusion does not apply where prohibited, including liability that cannot lawfully be limited for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence. Nothing in these Terms removes mandatory consumer remedies.
14. Indemnification
To the extent permitted by law, you agree to indemnify Momentum against reasonable third-party claims, losses, and expenses caused by your unlawful conduct, infringement of another person’s rights, or material breach of these Terms. This does not require you to indemnify us for our own wrongful conduct or where such an obligation is prohibited by consumer law. We will give reasonable notice of a claim and an opportunity to participate in its defense.
15. Governing law and disputes
These Terms and disputes arising out of or relating to these Terms or the service are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, except to the extent applicable federal law governs. Subject to any mandatory law providing otherwise, you and Momentum consent to the exclusive jurisdiction and venue of the state courts located in Pinellas County, Florida, or, where federal subject-matter jurisdiction exists, the United States District Court for the Middle District of Florida, Tampa Division.
Nothing in this section deprives you of mandatory consumer protections under the laws of your place of residence or any right to bring a claim in another court where applicable law requires that right.
Please first contact us so we can try to resolve a concern informally. This does not prevent you from exercising legal rights or meeting a legal deadline. These Terms do not require arbitration or waive class-action rights.
16. Changes to these Terms
We may update these Terms and will identify the effective date on this page. We will give notice of material changes and obtain agreement where required by law. Continued use after a change takes effect constitutes acceptance only to the extent permitted by law. If you disagree, stop using the service and contact us about account closure.
